Terms of Service
Last updated: July 23, 2026
These Terms govern access to and use of the Real Estate AI platform and the “Real Estate Agent” mobile app (together, the “Service”). By creating a workspace, signing in, or using the Service, you agree to these Terms on behalf of yourself and, where applicable, the company you represent (the “Company”).
1. The Service
The Service is a multi-tenant CRM for real-estate businesses: lead management, campaigns, telecalling tools, site-visit scheduling, payment demand tracking, communications, documents, reports, and AI-assisted features (transcription, summaries, data Q&A). Features may change as the Service evolves.
2. Accounts and access
- Accounts are created by a Company administrator; keep your credentials confidential.
- You must be 18 or older and authorised by your Company to use the Service.
- We may suspend access that threatens the security or integrity of the Service or violates these Terms.
3. The Company’s data and responsibilities
- Data ownership — the Company owns the lead, customer, and business data it stores in its workspace. We process it only to provide the Service, as described in the Privacy Policy.
- DPDP consent — the Company is the Data Fiduciary for its customer data and is responsible for giving notice to and obtaining valid consent from customers and prospects under the Digital Personal Data Protection Act, 2023, and for honouring their rights (access, correction, erasure).
- Telemarketing compliance — the Company and its telecallers must comply with the Telecom Commercial Communications Customer Preference Regulations, 2018 (TCCCPR), including DND preferences, permitted calling hours, and registered sender/template requirements for SMS and WhatsApp communications.
- Call recording — the Company is responsible for informing customers that calls may be recorded and obtaining any consent required by law before recording.
- RERA — the Company is solely responsible for the accuracy of property and project information it stores or advertises, including displaying RERA registration numbers wherever the Real Estate (Regulation and Development) Act, 2016 requires.
4. Acceptable use
You must not use the Service to:
- send unsolicited communications in violation of TCCCPR/DND or other law;
- store or process data you have no legal right to hold;
- upload malicious code, attempt unauthorised access, or disrupt the Service;
- infringe intellectual-property or privacy rights of others.
5. AI features
Transcripts, summaries, lead-quality verdicts, and assistant answers are generated by AI and may contain errors. They are aids, not advice — verify important information before acting on it. Audio and text sent to AI providers is processed as described in the Privacy Policy.
6. Fees
Paid plans, seat limits, and included modules are as agreed with us in writing or shown on your subscription page. Taxes (including GST) are additional unless stated otherwise.
7. Availability and support
We aim for high availability but do not guarantee uninterrupted service. Planned maintenance and factors outside our control (including third-party providers) may affect availability.
8. Intellectual property
We own the Service, its software, and branding. The Company grants us a licence to host and process its data solely to operate the Service. Feedback may be used to improve the Service.
9. Termination
The Company may stop using the Service at any time and may export or delete its data using the built-in tools. On termination we delete or anonymize workspace data within a reasonable period, except where retention is required by law.
10. Disclaimers and liability
The Service is provided “as is”. To the maximum extent permitted by law, we are not liable for indirect or consequential loss, loss of profits, or loss of data caused by events beyond our reasonable control. Our aggregate liability is limited to the fees paid for the Service in the three months before the claim. Nothing in these Terms limits liability that cannot be limited under Indian law.
11. Governing law and disputes
These Terms are governed by the laws of India. Disputes are subject to the exclusive jurisdiction of the courts of Guwahati, Assam, India. The parties will first attempt to resolve any dispute amicably within 30 days of written notice.
12. Grievances
Complaints and legal notices may be sent to the Grievance Officer at agarwaladvitiya@gmail.com (acknowledged within 72 hours, resolved within 30 days), as detailed in the Privacy Policy.
13. Changes
We may update these Terms; material changes will be notified inside the Service. Continued use after changes take effect constitutes acceptance.
